1. Voluntary Participation and Assumption of Risk
I acknowledge that my participation in the Retreat, including travel, excursions, movement activities, and use of accommodations, is voluntary and may involve risks. Costa Rica does not have accessibility requirements equivalent to the Americans with Disabilities Act (ADA). Terrain, walkways, and facilities may include uneven surfaces, stairs, steep paths, and other conditions requiring physical agility and balance. I affirm that I am in sufficiently good health and physical condition to participate and that I will take responsibility for my own safety.
2. Health and Medical Considerations
I certify that I do not have any physical or mental conditions that would put me or others at risk during the Retreat. I am solely responsible for obtaining any medical advice, vaccinations, or medications recommended for travel to Costa Rica. I understand that medical care may be limited or unavailable in some areas, and I am responsible for carrying adequate health and travel insurance.
3. Release of Liability
In consideration of my participation, I hereby release and hold harmless Kubuda, Casa Kia Ora, their owners, officers, employees, agents, contractors, and representatives from any and all claims, demands, causes of action, costs, expenses, or liability for injury, loss, or damage to person or property that I may suffer or incur in connection with the Retreat, whether arising from negligence or otherwise, to the fullest extent permitted by law.
4. Personal Responsibility
I am responsible for my own conduct, for respecting local customs and laws, and for any property damage I may cause. I understand that participation in some activities may be denied if I am deemed physically unfit or if I behave in a way that endangers myself or others.
5. Payment and Cancellation Policy
A $900 deposit is required to secure your spot and is entirely non-refundable. The remaining balance is due 60 days prior to the Retreat start date. Cancellations made 31–60 days before the Retreat will result in forfeiture of 50% of the total price (including deposit). Cancellations made 15–30 days before the Retreat will result in forfeiture of 75% of the total price. Cancellations within 14 days of the Retreat are non-refundable.
6. Travel Arrangements
I am responsible for arranging and paying for my own travel from my home to and from the San José, Costa Rica airport, including all necessary travel documents, visas, and insurance. Kubuda will arrange air transportation for Retreat participants as a group from San José to Quepos, Costa Rica, as well as group ground transportation from the Quepos airport to the Casa Kia Ora retreat site. I understand that I must be on time and ready to board the chartered small plane on the designated date and time so that I can travel with the group. If I miss my flight from San José to Quepos, I will be responsible for any additional charges required to reach the Retreat location. Kubuda is not responsible for delays, cancellations, loss, or incidents related to the small plane or ground transportation.
7. Group Activities
As part of the Retreat, Kubuda will offer an optional one-day group excursion to various locations in Costa Rica. Kubuda will provide small group bus transportation for this outing. Participation in this excursion is voluntary, and Kubuda is not responsible for any delays, incidents, injuries, losses, or damages that may occur during bus transportation or at any group activity location.
8. Weather
Weather in Costa Rica can be unpredictable and may result in power outages, though this is not a common occurrence. Kubuda has no control over weather conditions or their consequences. We will make every reasonable effort to keep participants comfortable during adverse weather and any related disruptions. No refunds will be issued due to weather-related issues or their effects on the Retreat schedule or accommodations.
9. Alcohol, Smoking, and Substances
The possession or use of alcohol, tobacco, vaping products, or illegal substances is strictly prohibited at all times during the Retreat. Violation of this policy may result in immediate removal from the event without refund.
10. Illness or Injury
Participation in the Retreat involves the possibility of illness or injury. In the event I become ill or injured, I understand that medical care is available nearby, including hospitals in Quepos and San Isidro del General, local doctors in Dominical, and a private clinic in Pueblo del Rio. I acknowledge that I am responsible for any medical expenses incurred. I am encouraged to secure travel insurance to cover illness, injury, or other unexpected events.
11. Photography and Media Release
I grant Kubuda permission to take and use photographs, video, and audio recordings taken during the Retreat for promotional and marketing purposes, unless I provide written notice prior to the start of the event that I do not consent.
12. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to conflict of law principles.
I have read and fully understand this Waiver and Release of Liability. I agree to these terms knowingly and voluntarily.
